D.A. Knew About Guns And Drugs And Cell Phone Video And Two Prior Sexual Assault Allegations In January 2018 Exposing More Potential Victims
ORANGE COUNTY – During a news conference on Tuesday, September 19, 2018 District Attorney Tony Rackauckas was asked why he sat on two known alleged rape by intoxication and/or drug cases, occurring in April and October of 2016. His response: his office did not know about the allegations until two weeks prior. That is patently false.
On January 9, 2018, the Newport Beach Police Department executed a search warrant on the home of the accused, Grant William Robicheaux. Pursuant to that search warrant, which is now under seal in the Superior Court, Harbor Court Division, illegal drugs and guns were seized from Robicheaux's property.
According to District Attorney policy (attached), any search warrant must be approved by a prosecutor before the police may present the warrant to a magistrate for approval. Given that the police were aware of two alleged rape allegations, most certainly such allegations were outlined in the probable cause declaration to the magistrate in order to secure the warrant. The return of the warrant was filed in the Superior Court and is now under seal. However, it was not always under seal and at one time was a public record. However, at the time of the seizure of the property, the District Attorney and his office were certainly made aware of what property had been seized including cell phone evidence. That warrant has the signature of the prosecutor who approved the warrant before it was allowed to go to the judge for consideration and approval and that prosecutor, Michael Carroll, signed off on the warrant on December 27, 2017 via email (attached).
Todd Spitzer said, "To purposefully sit on a case where two allegations of rape and oral copulation by use of drugs are two years old in conjunction with the seizure of illegal drugs and guns is unconscionable. To now hold multiple press conferences to call for more victims when such a call should have been made more than nine month ago when the cell phone video was seized and revealed sex acts is disgusting and politics at its worst. No wonder so many crime victims have turned against the District Attorney. How many more women were exposed to illegal acts since 2016 when these allegations first came to light? How many women were exposed to illegal acts since the cell phone was seized so that Rackauckas could time the arrest closer to his election? Who is the 'Wolf in sheep's clothing' now to quote Rackauckas?"
