BREAKING: Todd Spitzer Exposes Tony Rackauckas For Miserable Record on Hate Crimes

 

New Transcript Shows Rackauckas’ Office Allowed Violent Bigot Tyson Mayfield to be Released with Slap on the Wrist, Mayfield Went on to Perpetrate More Violent Hate Crimes

 

Orange County, California – October 1 – A newly released official court transcript confirms that the current Orange County District Attorney Tony Rackauckas’ failure to take hate crimes seriously endangers county residents’ lives.

 

After known bigot, Tyson Mayfield, violently assaulted an innocent victim in September 2017, Rackauckas’ office allowed a judge, by failing to object, to sentence this violent and dangerous criminal to a misdemeanor charge without a hate crime enhancement. Mayfield was eligible for more than 10 years in state prison under the charges originally filed by prosecutors. Just after his early release, swastika-tattooed Mayfield went on to menace and attack innocent victims in our county because of Rackauckas’ failure of leadership last year.

 

Last week, the Orange County Human Relations Commission released its annual report that proved hate crimes are increasing in Orange County for the third year in a row.[1] At the same time, data from the California Attorney General’s Office that shows that Rackauckas is failing to prosecute bias-motivated crimes to improve his much touted “conviction rate” while his counterparts across Southern California seek justice for victims and the community. Rackauckas only files charges in 57% (158 cases) of referred hate crimes from police (2004-2017) while LA County filed 70% (1147) between 2004 and 2017 of police referred hate crimes. San Diego and San Bernardino each filed 80% during this time.

 

Such criticism received a sharp, but empty response from Rackauckas claiming that prosecution is “based on more than just stats or numbers…” The OCDA even falsely claimed the California auditor ranked his record as the best in California when, in fact, the report he cited only examined a few dozen cases in three counties and made no such claims about any county’s prosecutorial effectiveness. In reality, the report chastised OCDA and OC sheriff for failing to train frontline officers on hate crime reporting techniques.[2]

 

But Rackauckas prefers to boast about his “impressive” conviction rate than take the necessary risks to keep the public safe from violent criminals, especially bigots like Tyson Mayfield.

 

In September 2017, Mayfield assaulted an innocent victim who is Filipino and Turkish. At that time, Mayfield approached the victim to borrow a lighter, became agitated with the victim who did not have a lighter, called him racially motivated names and punched him multiple times. The DA charged Mayfield with a felony hate crime with the ability to commit a violent injury carrying the possibility of three years in state prison. In addition, Mayfield has been convicted of two serious violent felonies of mayhem (disfigurement of another human being) and assault with a deadly weapon both which add up to an additional ten years in prison. He had additional enhancements which would have added more years to a prison sentence.

 

However, at the time of sentencing, with the DA present, Mayfield’s felony was reduced to a misdemeanor trading three years in prison for a maximum of one year in county jail. By doing so, the additional enhancements immediately disappeared—vanished—because they can only be added to a state prison sentence by operation of law.

 

In the attached transcript, the public will now know that the DA did nothing to object, make a record in opposition or offer to have the victim testify under Marsy’s Law to stop this insane plea bargain to the judge. No where will the public see in this sentencing that the DA objected; the DA sat silent.

 

Mayfield –with a swastika tattoo and a violent felony history – is now charged with assaulting an African-American woman at a bus stop and then stealing her backpack. Fortunately, she fled to safety by deploying pepper spray to defend herself. If Mayfield had been behind bars like he should have been, she would have been safe that day. This happened on September 17, 2018 when Mayfield should have been in state prison for his previous hate crimes in 2017.

 

The only reason Mayfield could assault innocents and terrorize the community again is because Tony Rackauckas did not do his job. Hate is up because Tony doesn’t fight for victims. He got his conviction, his stat and so he moves on not caring at all that Mayfield is now charged with his fourth victim in his criminal history.

 

Victims deserve justice – not Rackauckas’ grandstanding and self-aggrandizement. Not one Orange County resident should fear for their safety, let alone be harmed, because the county’s chief prosecutor refused to keep dangerous criminals off the street to boost his own resume.
