Spitzer Blew The Whistle On Rackauckas’ Phony Delay Tactics And Demands Public Apology By Rackauckas For Defamatory Remarks Claiming Law Violation
ORANGE COUNTY – October 23 – Today, following the court ruling to unseal the search warrant in the case of People v. Grant Robicheaux and Cerissa Riley, Todd Spitzer called for a public apology by Tony Rackauckas who wrongfully singled him out in a clear conflict of interest for referencing the search warrant on the home of the accused, Grant William Robicheaux. Todd Spitzer blew the whistle on Rackauckas’ phony delay tactics by staging the case before Election Day.
The court documents - including the search warrant - were public record, available for inspection for several months unsealed in the court. The attached minute order from today’s ruling states, “Court finds that search warrant released was public domain and lawfully obtained by the media.” Rackauckas owes Supervisor Spitzer and Chief of Staff, Melanie Eustice, a public apology after defaming them in a government DA press release stating that they had violated the law by distributing a sealed document. This is now just another case of Rackauckas’ “lazy law” practice.
The Todd Spitzer for District Attorney campaign released the following statement, "We all know that Tony Rackauckas is a terrible lawyer and a worse liar. He told the press that his office had been aware of the case ‘a few months ago,’ prior to the arrests. That was a lie. Spitzer released the search warrant signature page on September 21, 2018 proving Rackauckas knew about the case all along. Then Rackauckas continued to lie when he called for more victims, exploiting his own failure to act since the rapes, which occurred in April and October of 2016.”
He continued, “What desperate human being, let alone a prosecutor, sits on a case just for the purposes of using it close to a re-election to get free publicity and so he could be viewed as a hero to save the day helping new victims? Only because I had the warrant, obtained lawfully, was I able to disclose the truth to the press and the public that the suspects were described as ‘high risk sexual predators’ and ‘more victims are believed to be unidentified’. Rackauckas thought he could hide behind the court documents being sealed. Rackauckas took a tactic from Mike Nifong's playbook, the disgraced prosecutor who went after the Duke Lacrosse players to help his election. I hope the voters see through his misconduct."
